Worker's Compensation

Protecting the right of worker's

When you are injured at work it is important for you to obtain your own attorney to protect your rights. Kamensky♦Cohen will investigate all aspects of loss related to an injury sustained while on the job. We will represent your interests for:

  • Medical Treatment
  • Income Loss Compensation
  • Permanent and/or Temporary Disability Issues

Regardless of fault, any employee injured at work is entitled to three benefits:

  1. FREE MEDICAL CARE - No co-payments or deductibles. The employer and insurance company, by law, have the right to select your treating physician.
  2. TEMPORARY DISABILITY BENEFITS - 70% of average gross weekly wage up to a per week maximum that changes each year. Your attorney will be able to give you the most recent per week maximum.
  3. CASH SETTLEMENT - This is awarded by the court to compensate for the percentage of loss of function caused by the injury. The insurance company may not advise you of this portion of your legal rights. You should call Kamensky♦Cohen as soon after the accident as possible to obtain this benefit. Our attorney will discuss your injuries, advise you and help you optimize the amount of cash settlement for your damages/injuries. There is no up front cost to you, fees will be taken from your recovery settlement, the amount of which is a percentage dictated by the court.
