Our Immigration Law Firm in New York Can Assist You With:

  • Artist Visas. If you are a celebrated artist in your field, you may qualify to live and work in the United States on the merits of your achievements. The EB-1 visa, a green card that confers lawful permanent residency, can be issued to those that can demonstrate “extraordinary abilities” in their field. If you do not wish to pursue lawful permanent residency, O visas also allow artists with “extraordinary abilities” to live and work in the U.S. and can be often issued more quickly than green cards. Our team regularly works with photographers, actors, musicians, models, dancers, acrobats, and many other types of artists and performers.
  • Family-Based Immigration. United States citizens and lawful permanent residents have the ability to sponsor certain types of family members for green cards. Those sponsored in the immediate relative categories will not have to wait for a visa to become available and thus can generally more expediently secure lawful permanent residency. Relatives in the family preference categories can face long waits depending on their country of origin, relationship to the sponsor, and the current visa backlog. We can help petitioners sponsor their loved ones and advise on what types of waits they should expect.
  • National Interest Waivers. Most forms of employment-based immigration involve securing an offer of employment from a U.S. company. The sponsoring company must then obtain labor certification, a costly and time-consuming process. Procuring a national interest waiver allows you to self-petition for an employment-based green card and skip the labor certification process. To do so, you will need to qualify for the EB-2 visa, which involves having exceptional abilities or an advanced degree or a bachelor’s degree with at least 5 years of experience. You will then need to demonstrate that the work you intend to do in the United States will have “substantial merit” and be of “national importance.” We can assess whether you may be able to qualify for a national interest waiver and assist in making your petition as persuasive as possible.
  • Removal Defense. We can help you pursue relief strategies if you have been placed in removal proceedings. If you have been detained, we can work to schedule a bond hearing and secure your temporary release in advance of your hearing. Our attorneys have represented immigrants in courts throughout the country as well as the Board of Immigration Appeals and various circuit courts.

  • Employment-Based Immigration. Companies based in the United States can sponsor prospective foreign employees for green cards that will allow them to permanently live and work in the country. Employment-based immigration involves procuring PERM labor certification that demonstrates that there are no qualified U.S. workers available or willing to fill the vacant position. A limited number of visas are annually distributed across several preference categories: Those with “extraordinary abilities” receive top priority, followed by those with advanced degrees, professionals with bachelor’s degrees, “skilled” workers, and “unskilled” workers. Certain types of workers and professionals do not necessarily require an offer of employment. We can review your qualifications and guide you and your sponsoring employee through the labor certification, sponsoring, and application processes.
  • Investor Visas. The EB-5 visa is a type of employment-based green card that is reserved for immigrant investors. To qualify, an entrepreneur must invest at least $1,800,000 in a commercial enterprise that stands to create at least 10 full-time jobs for U.S. workers. Alternatively, an entrepreneur needs to only invest $900,000 in a rural area or area with high unemployment that is preapproved by United States Citizenship and Immigration Services (USCIS). Our team can help you provide the appropriate documentation and work with you throughout the process.
  • Startup Ventures. Several types of visas can help founders and entrepreneurs build a business from the ground up or expand an existing business into the United States. In addition to the EB-5 immigrant investor green card, the E-2 treaty investor visa allows certain types of investors to live and work in the United States to manage their substantial investment in a commercial enterprise. The L-1 visa can also be leveraged to help international companies send executives, managers, and employees with specialized knowledge to establish a new office in the United States. We can help you or your company identify visa solutions that can facilitate startups and other types of commercial ventures.

Our immigration law firm in New York can help you explore all of your visa options. Call J&K Law today at (212) 390-1024 or contact us online to get started.
